LAWS 9971 Banking Regulation
This course begins with a deep dive into the laws governing money and central banking. We examine the special role of banks as delegates of sovereign power over money creation and management, and the nature of the bank charter. Drawing on major schools of theory and on the lessons of the crises that have reshaped banking law, we study how the Federal Reserve System, the Office of the Comptroller of the Currency (OCC), and the Federal Deposit Insurance Corporation (FDIC) pursue financial stability, inclusion, and integrity. We consider " shadow banking"--bank-like activity outside the collapsing federal regulatory perimeter. We also explore financial innovation, including the OCC's new charters for payment stablecoin issuers under the GENIUS Act. Throughout the course, students develop a command of the statutes, regulations, doctrines, constitutional provisions, international agreements, industry rules and norms, and practical customs that shape banking.
